Terms and Conditions Effective Date: 1st February,2025

Welcome to Hexia Health App, a comprehensive digital health app designed to assist you in managing your health and wellness. Our services include an AI-powered symptoms checker, a telemedicine platform that gives quick to medical practitioners, pill reminders, wellness checks, integration with third-party laboratories and pharmacies, and health literacy resources. By using our app, you agree to these Terms and Conditions ("Terms"). Please read them carefully.

1.  Acceptance of Terms

By accessing or using [Hexia Health] ("App"), you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, please do not use our services.

2. Services Provided

Our App offers the following services:

  • AI-Powered Symptoms Checker: An AI-driven tool to help users understand potential health issues based on symptom input to empower you to take charge of your health.
  • Telemedicine Platform: A virtual platform to access a dedicated team of certified doctors and other health practitioners for virtual consultations through Video calls and Voice calls
  • Pill Reminder: A feature to help you remember to take your medications by sending notifications to your phone as daily reminders.

     E-Prescriptions with Home Delivery

Our platform simplifies the prescription process with e- prescription sent directly to our Pharmacy partners and medications delivered directly to your doorstep. This service not only saves time but ensures you have quick access to your prescribed medications, supporting better health outcomes. Refilling your prescription is also made easy with Hexia health app.

  • Wellness Check: AI-powered health assessments to monitor and promote overall wellness measuring your energy, immunity, mental risk, stress level, respiratory rate, sleep pattern, etc.

·   Physiotherapists Management

At Hexia Health, our dedicated team of physiotherapists is committed to helping patients enhance their physical function and mobility. We focus on facilitating a swift recovery from a wide range of movement related conditions, pain issues and rehabilitation needs.

  • Third-party Laboratories and Pharmacies: Integration with external providers for lab tests and access to medication and delivery to your doorstep.
  • Health Literacy: Resources and information to improve users' understanding of health-related topics to empower you to improve health and wellness through informed decisions.

   24/7 Customer Support

At Hexia Health we provide 24/7 customer support to ensure patients have access to quality support anytime, anywhere. Our fantastic customer service team is just a call away, ensuring a smooth and reliable experience round the clock on Hexia app.

3.Eligibility

You must be at least 18 years old to use our services. By using the App, you represent and warrant that you are 18 or older and have the legal capacity to enter into these Terms.

4. User Responsibilities

You agree to use our services only for lawful purposes and in accordance with these Terms. You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account.

5.AI-Powered Symptoms Checker

The AI Symptoms Checker provides general information and is not a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of a qualified healthcare provider with any questions you may have regarding a medical condition.

6.Telemedicine Platform

  • Consultations: Telemedicine consultations are provided by licensed healthcare providers. However, the app is not the entire solution for every case and is not a replacement for in- patient care in all cases. You consent to receive medical care and treatment by using the telemedicine consultation on the app
  • Limitations: There may be limitations to telemedicine consultations based on the nature of your condition and the information provided.
  • Medical Records: By using the app, you hereby authorise and consent to the electronic recording and storage of your telemedicine consultations data and related information to serve the purpose of providing care and compliance with applicable laws.

7.Pill Reminder

  • Accuracy: While we strive to provide accurate reminders, you are ultimately responsible for managing your medication schedule.
  • Notifications: Ensure that notifications are enabled on your device to receive reminders.

8.Wellness Check

The AI - driven facial scan for wellness provides general information and is not a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of a qualified healthcare provider with any questions you may have regarding a medical condition.

  • Assessments: Regular health assessments are designed to monitor and promote your overall wellness.
  • Recommendations: Based on your assessments, you may receive recommendations for lifestyle changes, follow-up actions, or consultations with healthcare providers.

9.Third-Party Laboratories and Pharmacies

  • Third-Party Services: Our App integrates with third-party laboratories and pharmacies. We do not control these third- party providers and are not responsible for their services. It is your responsibility to read and follow the terms and conditions of the third-party companies.
  • Pharmacies: You can refill your prescriptions on the app and have them delivered to you or you can pick them up from pharmacies that we partner with, you can also have an e- prescription sent to those pharmacies. Refunds are not accepted on medications.
  • Orders and Results: All orders and results from third-party providers are subject to their terms and conditions. We do not guarantee the accuracy or completeness of any third-party lab results or medication fulfillment.

10.Health Literacy

  • Resources: The health literacy section provides educational resources to improve your understanding of health-related topics.
  • Accuracy: While we strive to provide accurate and up-to-date information, these resources are for informational purposes only and do not constitute medical advice.

11.Subscription Plan

  • Subscription: Plan subscriptions are the way that users get access to our app.

There are 4 subscription plans and features for each plan are revealed in the app only the feature items under each plan can be redeemed under each plan you subscribe to. It is a recurring service, paid monthly or yearly. Subscription fees are billed at the end of each payment period, you agree to the subscription terms and authorize us to charge your payment method periodically using your payment method.

12.Cancellation Policy

  • Monthly Subscriptions: You may cancel your monthly subscription at any time. The cancellation will take effect at the end of your current billing cycle, and you will not be charged for the subsequent month.
  • Annual Subscriptions: Annual subscriptions can be canceled at any time, but refunds will be prorated based on the number of months remaining in the subscription period. A small cancellation fee may apply.

To cancel your subscription, follow these steps:

  1. Log in to your Hexia Health account.
  2. Navigate to the ‘Profile’ section.
  3. Select the ‘My Subscription’ tab.
  4. Click on ‘Cancel Subscription’ and follow the on-screen instructions.

13.Refunds

Refunds are provided under the following conditions:

  • Monthly Subscriptions: No refunds are issued for partial months.
  • Annual Subscriptions: Prorated refunds will be issued based on the unused portion of your subscription. The refund amount will be calculated from the date of cancellation to the end of the subscription period, minus any applicable fees.

14.No Refund Situations

Refunds will not be issued in the following situations:

  • If you fail to cancel your subscription before the next billing cycle begins.
  • If your account is terminated due to violations of our Terms of Service or other policies.
  • If the services were fully utilized before cancellation.
  • If you do not attend your doctor's appointment without rescheduling or canceling your appointment

15.Reinstatement

If you decide to reactivate your subscription after cancellation, you may do so by logging into your account and selecting a new subscription plan. Please note that previously earned benefits or promotions may not be reinstated.

16.Changes to Cancellation Policy

Hexia Health reserves the right to modify or update this Cancellation Policy at any time. Changes will be effective immediately upon posting to our website or app. We will notify you of significant changes via email or through the app.

17.Privacy

Privacy use of the App comes under our Privacy Policy, which describes how we collect, use, and safeguard your personal information. By using the App, you consent to our collection and use of your data as outlined in the Privacy Policy.

18.Intellectual Property

All content, features, and functionality of the App are the exclusive property of Hexia Health Limited or its licensors. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store or transmit any of the material on our App without our prior written consent.

19.Disclaimers

  • No Warranty: The App and services are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied.
  • Health Information: The health information provided by our Wellness Check, and Health Literacy is for informational purposes only and does not constitute medical advice, diagnosis or treatment. Kindly consult your health practitioner if you are not feeling well.
  • AI - Powered symptoms checker result is for guidance on what might be wrong and does not replace a consultation with a medical practitioner

20.How to make a complaint

If you have a complaint, please by following these steps:

Log in to your Hexia Health account.

Navigate to the ‘Profile’ section.

Select the ‘Support’ tab.

Click on ‘Click on the ‘Complaint’ button and document the complaint, the issue, and the time.

Alternatively, you may contact our Customer Support team at Hello@hexiahealth.co.uk for assistance or phone call and we will try our best to resolve all issues and complaints within 24 hours.

21.Limitation of Liability

To the fullest extent permitted by law, Hexia Health Limited shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (i) your use or inability to use the App; (ii) any conduct or content of any third party on the App; (iii) any content obtained from the App; and (iv) unauthorized access, use, or alteration of your transmissions or content.

22.Indemnification

You agree to indemnify, defend, and hold harmless Hexia Health Limited and its officers, directors, employees, agents, licensors, and suppliers from and against all claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the App.

23.Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the Federal Republic of Nigeria, without regard to its conflict of law principles. Any dispute arising under or in connection with these Terms shall be resolved through binding arbitration in the Federal Republic of Nigeria, except that you may assert claims in small claims court if your claims qualify.

24.Changes to Terms

We may update these Terms from time to time. We will notify you of any changes by posting the new Terms on this page and updating the "Effective Date." Your continued use of the App after such changes constitutes your acceptance of the new Terms.
